Do you still have a lawyer? I would speak to them. I don't know if you can legally prevent her from smoking around your child or not. But maybe the lawyer can do somthing. Such a shame when a parent puts their own selfish needs infront of their child's health. I mean all she has to do is go outside.

Speaking to a lawyer is good advice but I might first visit the childs pediatrician and get some medical data proving he already has breathing problems and being around cigarrette smoke would exaserbate the problem. Getting this info in writing would certainly put things in your (and your sons) favor.. The lawyer might be able to a clause thrown into the visitaion agreement about a smoke free environment while the child is in her care. By the way, since this could be viewed as a child abuse or child endangerment issue, child protective services might have something to say about it too.

You sure can take her to court. In custody battles, anything goes and in this case, its your childs life long health. I would call your lawyer, tell them what is going on and say you want a stop put to it immediately, get an emergency custody order with your reasons and go from there.
