  • Of course they can. Their job is to enforce the law, and in this case to catch people who violate the rules of the road. It doesn't matter at all what the cop was doing, what matters is what the person breaking the law is doing. There isn't some kind of game involved, where cops have to give someone fair warning and a chance to stop what they're doing. It doesn't work like that. You break the law, you get caught, you face the consequences... sorry, but that's the way it works... and it works the same way in every state in the country.
