  • Consult with an attorney as you will have attorney-client privilege. Sexual contact with a minor (molestation) is illegal in all 50 state, even with consent (because a minor cannot legally give consent) and the pregnancy and possibility of a paternity test is all the proof a prosecutor would need. If anyone brought it to the attention of the police they could investigate the matter. Depending on local statues (and this is why I suggest you consult an attorney) your parents could get in trouble for not reporting the crime. Good luck.
  • Why are your parents not pressing charges? He's guilty of statutory rape, and if they don't press charges, your parents are guilty of abetting a felonious crime. He and they could all go to prison. And you could wind up in the custody of the State for at least he next three years. You've got yourself in a fine mess, little girl.
  • First, this is second degree rape in Oklahoma. A minor under 16 cannot consent to sex with someone 18 or over in your state. Second, the act has already been committed. Therefore, moving to another state does not make the already committed act legal. Third, the decision to prosecute lies solely with the prosecutor. Even if your parents are okay with the intercourse and say they don't want charges brought, the state can still prosecute. Whether or not the father will be prosecuted varies widely by jurisdiction. In some counties, the DA will prosecute every such case. In others, the DA will not charge if the ages are close (even though it is actually a violation of the law).
