If I talk to a lawyer but do not hire him or her, is our conversation protected?

    I must disagree with the other answer to this question. Information you provide to a lawyer for the purpose of seeking advice or possible representation is protected from disclosure by the attorney client privilege, regardless of whether you hire the lawyer. This means that the lawyer cannot divulge the information you provided unless you agree to allow her to do so.

    It would depend on the jurisdiction (I often have to remind myself that a Website such as this applies to an international audience). That said, I would say yes, as it would be presumed that you spoke to the lawyer to receive legal advise. That conversation by default would have solicitor client privilage.

    Just to be safe, you take a friend with you when you talk with the lawyer and be upfront and ask him if your problem will be confidential before you start.
