  • unless there was"no joint tenants vesting" nor specify legal explanation on previous title on ownership, there must be a good reason for title not wanting to do this..remember they are insuring the transaction sale or reffinance...have the broker involved to help you resolve this...death of spouse not a issue unless there are other factors
  • This depends why title insurance is being issued. Are you selling the property? In some states after a joint tenant dies the surviving spouse must record a affidavit of death of joint tenant, along with a certified death certificate. It sounds like the title company doesn't want to issue a policy until they are assured of a clear title. Ask them what they actually need to clear this up?
