As long as the parents agree to their decision -- as soon as they can communicate they can select which parent with which they want to reside. As for the legal implications, that depends on what country you reside in.

It depends on the State, County/Parish you live in. And most definitely the presiding Judge on your custody case!

The legal age is 18. Kids can not decide which parent they want to live with. Obviously if the kid voices this to the parents and they agree then that's a lot different. But if we are talking about an on going custody battle where a non-custodial parent who has a child that wants to live with them over the other parent (which is usually how it goes) obviously custody is the way it is for a reason. You need to take this to court and bring your valid reasons to a judge. They may or may not listen to what the child says but a lot of times they won't take what they say into consideration because they don't like to put the child in the middle. They will look at what's in the best interest for the child and make the decision accordingly. You can't just bring a motion to the court and say my daughter/son wants to live with me...you have to have a good reason/change in circumstance or that the child is in danger etc.
