  • Not sure if its international or even nation wide. But in my state you couldn't be placed in jail if your term was longer than 366 days. So basically it comes down to the severity of the sentence on where you are placed. Also jails were run by local or county departments and prisons are run by federal/state bureaus.

  • The difference between jail and prison is that generally, if someone is going to jail, their sentence is a year or less. If they have over that, it's prison. In the state of Minnesota, however, if with credit for time they've already served, the actual time they have to be incarcerated ends up being less than 180 days, they serve that time in the county jail instead.
