If you signed a TAA lease contract then paragraph 23 states that the owner is required to allow you to move out early under certain circumstances which includes "relieved or released from active duty". By law, landlords cannot refuse to return the deposit without a valid reason. Your security deposit or a list of itemized deductions must be given to you within 30 days of you leaving. A few things: First, there is no Texas law that mandates a landlord let you out of the lease. You only have this right if it was part of your lease. Second, you said your Husband signed the lease in El Paso, yet you were discharged. Thus, even if the complex was a member of the TAA, paragraph 23 would not apply to you. Third, why were you discharged? If you knew about the discharge when you signed the lease, you would still be liable for damages (under the TAA lease).
