I'm not a lawyer, but some state laws say that everything will be divided 50/50; however, I believe this occurs prior to other factors being taken into consideration, such as someone cheating (but again, I'm not a lawyer and I don't know what state you're in so I wouldn't be able to say). A lawyer in your state will be able to tell you more about this. Good luck, and I hope you'll be able to say that your husband got zilch from you.

Thanks to all who answered my question. I'm an Illinois resident trying to hold on to a retirement that my cheating spouse is trying to take away from me through a divorce.

Contact a lawer who specializes in divorce w/property settlement. If you can prove that his motive is simply to obtain money to pay off debt, then you've got him on a form of extortion. You can also contest the divorce using these grounds. Sadly, most states wont allow this contest on the grounds of adultry if the other spouse (you) knew of the act and continued to allow him to reside with you. Your best bet is to draw up a separation agreement that states that neither party will stake claim to the other's assets such as IRA's and pension plans. If he refuses to sign, then the divorse should not be able to take place, and therefore he will get no money. Also, I would make sure that he is not listed as a beneficiary to any of these accounts. If so, get his name removed immediately, to prevent him from saying that he is entitled to the money. Good luck and God bless.

Get a good lawyer that can protect your retirement. My ex also cheated repeatedly. If you stay married be prepared for a life of secrecy, lies and more cheating! You should have divorced him a long time ago!
