  • Does this daughter know who this man is? Has he been in her life? Was his name on the Birth Certificate? If so, you have to think about the daughter and how it would affect them. Also, I know some places have something called a petition to amend a birth certificate. Would it be considered defamation is a good question. I have yet to hear of a case that considered that.   • Don't be so petty about it. So what. Let the child be. Hasn't she been through enough. ********** As far as defamation, she would have to have known 100% that the child wasn't his when claiming she was and naming her that AND it had to have caused him problems with his reputation. This is not defamation of character.
  • 1. No he can't require her to change it. You can name your child -almost- whatever you want, barring numbers and symbols (here at least). 2. As for defamation, it doesn't qualify as defamation unless she's still going around claiming the child is his after the paternity tests proved that it wasn't. As an aside, if you choose to pursue some sort of legal action if she -is- claiming the child to still be his, keep in mind that you have proof that it is not, and she's only making herself look more a fool and a philanderer - in short, I'm not sure what you could gain from such pursuit besides a hefty legal bill on your side, and depriving her unfortunate child of ... well, something, be it monies her mother would spend on the child or ... whatever. My advice is to send Maury Povich her contact information...
