It all depends. If you simply plwed through someones front yard ran over their prize rose bush and tore up their lawn I don't think you should be sentenced to hard time in prison for years and years. You should however be made to pay restitution for the damages you caused. On the other hand If you cross the median on the highway and ram head on into a mini van carrying a mom dad and thir kids on the way to a family or holiday gathering and you wipe out said family I think you shuld be charged with murder and spend the rest of your rotten miserable life behind bars for what you did.

No. I think that the 1st DUI should just be a warning and if you get pulled over again then you should get a DUI.
