This will largely depend upon which state you are in. However, there are a few items to consider: 1) If you were never married to the mother, and not seeking a divorce, any form of "cause" may be disregarded. (In may states, unmarried parent situations are still looked at as being "immoral" in and of themselves. In other states, a parent's new partner does not factor into a custody issue, unless that partner is a danger to the child in some form.) 2) Is that person a danger to your child's physical, mental, sexual, emotional health? How has the mother incorporated this individual into your child's life, and would an outside individual reasonably believe that this constitutes a "danger". 3)For child support purposes (assuming you pay), does the income or assistance she receives from this person possibly chane her income / expenditures significantly enough to affect the child support. If she is gainfully employed, that will be less likely, but is a possibility. The only person who could advise you competently in this matter is a family law attorny from the state this action would take place in.
