  • Custody consists of two different kinds: "physical" - where the kid actually lives, and "legal" - authority to make decisions pertaining to the child's medical care, education, etc. If you do not have joint physical custody, but have joint legal custody (which is most cases), and you have visitations with the kid, your child's mother cannot move without the court's permission. If you don't have any custody - neither physical nor legal - but have visitations, she still cannot move without court's permission. The courts are reluctant when it comes to custodial parent moving with the kid to another state. There will be hearing and you should be notified. But, in any event, she cannot just pick up and move - there has to be judicial approval.
