  • its just my opinion but i think if the father i fit to take care of the child and is willing and the mothers not afraid he'll run off with the baby somewhere that the father shoud have a shot at taking care of the child but its totally the mothers choice where she leaves her child when she goes to work or where ever....
  • Where are the rights of the child in this calculation?? My opinion... Grandparents do NOT have more rights to care for the child than the Father. That would be as a general rule. Of course, if the Father is a low-life who cannot be trusted to care for the children, whereas the Grandparents can be trusted - then I would say the child should be entrusted to the Grandparents. That is not on the basis of the basis of the rights of either Grandparents or Father, but on the rights of the Child to good care which must take priority.
  • Grandparents do not have more right, legally, unless the father has been proven to be unfit to care for the child. Unfortunately, the child and their rights are often forgotten when adults start fighting over whi is a better role model/parent/carer. The grandparents should recognise that whilst they might be a great help and reliable source of care, they cannot substitute a childs' need to understand where they came from and for that they need both parents to be a part of their life - even if the parents canot stand the sight of each other!
  • Hell no! But if you cant stay amicable during the divorce, then this is what happens.
  • the child is the mother and fathers responsibiluty and if you have grandparents that r willing to help out then great! if the father is avalibale and able 2 care 4 a child then it falls on him. During the fathers visitation time its his responsibility if he needs his parents 2 babysit coz hes busy then its just like you jiring a babysitter. but he should spend time with the child himself. grand parents dont have more right its the parents choice at the end of the day (unless theyre not stable enough 2)
  • This is why First Right of Refusal needs to be included in any custody order, and why attorneys leave it out. It generates income later on.
