As long as the officer is trained on it, he can tell when it is giving a bogus reading and would not give you a citation. Since you are asking about technicalities, I assume that you were indeed speeding, so I would ask the prosecutor to reduce the speed that you were going over the limit so that you don't get as many points and as big of a fine and plead guilty.
