  • You are supposed to file even if you do not owe. I would get the tax thing cleared up, all past returns filed as part of the court order or negotiation during the divorce. If you don't you are liable even after the divorce.
  • Everyone must file a federal income tax, except those people drawing social security under a certain anuual amount. Income tax evasion is a serious crime and can land both of you in prison. Before the divorce, i would contact an agent of the IRS and ask your question.
  • Your question seems to imply that your husband did not owe for the last 4 years, but you did. If this is the case and you have not been filing, you have committed a crime. As for how it will affect your divorce, this will all be worked out if your divorce decree.
  • If you did not work for the 2007 year, and are implying as to whether the two of you can file jointly and you still receive money, then depending on where you live, you can still file after divorcing this year for last years taxes jointly, and also depending on what state you're in can collect up to half of his return.
