He can ask for it, but even if it's granted, it will most likely be for a limited time. And it's always possible the judge won't allow it.

It depends if you are in a state that supports alimony. Since he is physically disabled form the COPD, he can ask for spousal support since you have been footing the bill for the last 2 yrs. Have you thought about a separation before a divorce? Maybe he just needs a wake up call for him to see that you will not tolerate his actions.

Wow, this guy is a winner. I doubt he will get money out of you in the courts and if he does, he will probably drop dead from his untreated illness or he will overdose on drugs very soon anyhow. I wish you the best.

If your state allows spousal support, yes. The choice to not work is considered a marital decision (even though you say it is his decision). It is no different from a woman or man choosing not to work to raise children. Thus, if your income is the only financial support for the marriage, then he is entitled to maintain the marital way of life. He may actually be entitled to longer support than most. Spousal support is usually reduced over time while the recipient spouse returns to the workforce and becomes self sufficient. Here, your husband has emphysema which may limit his ability to become self sufficient.
