If you only lived with your mother for six months or more of 2007, your mother can claim you if you have a medical condition that prevents you from pursuing substantial gainful activity.   • That is correct. You do not have to file income tax and your mother can claim your son. She may also be able to claim you, there are some rules to be able to do that. She either needs to read up on that or see a tax consultant. I went to a tax consultant because I am in a similar position to your mother. Good luck.
