NOTE: This answer applies to America. I know the UK has much stricter privacy protection laws. The answer depends on what you mean by "rightfully his." There are two areas of law at play here. The first is copyright. If your ex gave you the nude picture, you have the right to dispose of that picture as you wish, but you cannot reproduce it because you do not own the copyright of it. If you are the copyright holder, the second area of law that comes into play is "right of publicity." This is the area of law that makes people get model releases. Right of publicity is your right to control the use of your likeness in commerce. Even if you own the copyright, you still cannot use a picture of someone else for a commercial use without there consent. Thus, so long as your use is not commercial, you can post the picture.

Yes. He can get in legal trouble for that depending on where you live. I've heard about stories like this on the news more than once.

Yeah you could probably be sued for defamation of character, obscenity, distribution of obscene material via the mail. So yeah that is legal trouble. Would you win? It depends on a lot of factors such as did he take these pictures in his own home? Is he attaching any information to it that is untrue or slanderous? It is a tossup who would prevail in most US juristictions.
