  • After 2 yrs. I doubt you can do anything. When you moved you should have taken picture of the entire apartment to show how you left it and then you should have taken the land lord to small claims court to collect your security.
  • I believe there is no statute of limitations regarding when you can get your security deposit back. However, waiting two years wasn't a great idea. Hopefully you have some photos or video showing you the way you left the premises. Regardless, by Florida law the landlord had to send you a written notice of itemized deductions from your security deposit within 30 days. If he did not do this, he forfeits his right to the security deposit. You can then go after him in small claims court for the full amount. The Florida Dep.
