However, if you live in a country like Canada where you are "Innocent until proven guilty", chances are you might not get put in jail as long as you can raise reasonable doubt. In a criminal matter, the Crown has to be able to prove that you are guilty beyond a reasonable doubt. If there is any doubt at all, they have no other choice but to let the accused go.

  • Most likely, however, what you are arrested for and what you can be charged or convicted of are two different things. 2nd degree murder is the intentional killing of another person with malice aforethought. Malice aforethought is the intent to kill, or the reckless disregard for life. Thus, if you knew, or should have known, that someone opening the fridge would likely suffer death, then you are guilty of murder.
