Sounds like a "War of the Roses" kind of thing to me. I strongly suggest you speak to an attorney - a divorce attorney and discuss with him/her your options and how the law in your area affects things like who gets what. Too often children become a battle point in divorce cases, they are used as weapons which - frankly - can really screw them up later in in life.

Try to stay focused on what's best for your child. It's sad that he wants to use your baby as a pawn to hurt you. If you want a divorce consult a divorce lawyer as soon as you can to know what options you have available. I do know that most states favor the mother in terms of custody issues, especially if the child is an infant. Unless he has a lot of money to spend on a lawyer fighting you for custody, I wouldn't take his threat too seriously just yet. Here's a legal tip: If you do decide to file for divorce, consult with as many local lawyers as you can. Once a lawyer has talked to you, even if it's a free consultation, the cannot represent him because it's a conflict of interest. He will have a hard time finding someone to help him. I'm not sure if this is a statewide or nationwide thing...but that's the way it is in my state.
