  • I don't have the expertise to answer your second question but, yes, in most places it is the responsibility of the real estate agent to provide that information to you during the buying process. I think in most jurisdictions, the CC&Rs would be considered part of the contract. But don't hold me to it. If you really want to void the contract, it would be worth talking to an attorney.
