I'm no lawyer but I would guess that it depends on how the employer tries to justify the change. If they can somehow prove that the employee is a contractor (they can't tell the contractor how to do their job), vs an employee, then I guess they can. But it is mighty suspicious when you make that change half way through the year isn't it? Did you know that if you don't think your employer is doing the right thing, you can actually contact the IRS and let them know? It'll get the employer in trouble.
