The Supreme Court has ruled that the police do not have to give or sell radar readings, to the public. I do not understand how you were impeding traffic, if you were going 3 mph over the posted speed limit. Go to court. you just may win this case. John

To me it depends on how much the ticket was. If it was not too much I would just pay it , not worth the time or trouble, also you said he gave you a break so I guess you know you were speeding, so just pay it.

That's a flipping outrageous ticket. Sounds like the cop had nothing better to do. Did you happen to be in a small town? They pull that garbage all the time where I live; speed traps in residential zones, pulling people over for under 5 miles over. Ridiculous! I'd fight it. You weren't being reckless, you weren't speeding like a maniac, and there's no way you were "impeding traffic." Sounds like you just met an asshole on a bad day. Radar units are calibrated for +/- 1 MPH so 3 over means that you absolutely were in excess of the posted limit and the sign is prima facia evidence that your speed was excessive. Many departments have a department policy about speeding and how fast someone must be going in excess of the posted limit before they will stop them. Was it really chicken s**t that he stopped you for 3 MPH over? Absolutely. It really comes down to what the judge wants as far as the speed goes. If the judge doesn't want 3 MPH speeding tickets in their court then the officer shouldn't try writing them. Fighting it could go either way for you. You could win and the citation could get thrown out and everything could be just great or this guy could be the jerk he seems to be for stopping you for 3 MPH over the posted limit and hold it against you for fighting the ticket after he "gave you a break" and he could make your life very unpleasant. It is very unfortunate that guys like that are allowed to wear a badge, but it happens.
