  • I would sure think the HOA (board) should be held responsible for violating its own rules and should reimburse the "victims."
  • In most States that created the "monsters" called HOA's the Statutes that "regulate" the Association, therefore the Board's actions fall under Civil Law. So YES - your board can be held responsible - but it is very time consuming and expensive to prove your point in court. The owner towed can send a demand letter quoting your bylaws and request reimbursement..however, the Board does not have to respond. "Sucks don't it?"
