instead of worrying about that, you should take him to court and get the house to be your sole responsibility. if you still owe money on it then see what you can do to get his name off of it. you may have to re apply to see if only you can be on the loan, but do what you have to so this doesnt become an issue.

Legally I don't believe there is any way he can sell your home without your consent or knowledge. However he could illegally do it.I am no expert on Real Estate Law but I am pretty sureyou would have to consent to the sale and short of him getting anyone to pretend they are you and forge your signature there is no legal way he can sell it. Putting you out is different. He could go to court and get an order of eviction but it is highly unlikely a judge will grant one since you are co owner and espicially if there are kids involved and they live with you in the home.

If your name is on the mortgage or deed, then no. It will take both of your signatures to sell the house.
