  • No, not without other substainuating evidence. at least, not in my state. heres an example: in advance, if the officer knew you did not have a valid license, then yes, the stop would be valid and your arrest or citation would be valid. mere suspicion of an offense, is not grounds for a stop. this is covered in the constitution of the united states. note: in some states, some highway patrol officers can make a traffic stop, just to check you for a valid drivers license.
  • This depends. If it's racial profiling [say you're a 35 year old Mexican], and a cop assumes because you're Mexican that you can't possibly have a valid license, then it's unethical, but not illegal. If you take this to court, the officer might be fired, but you will still be forced to get a valid license. However, if you are 12 [or look 12] and are driving by yourself, yes, he can and you can't do anything about it, if you don't have a valid license. If you do, then it's not a big deal. But if you don't, then he probably had a good eye.
  • All an officer has to do is run your plate as a matter of routine. He can do this with justification if he notices a minor infraction or any faulty equipment. Once he runs the tag, your driver status will come up. He can pull you over and issue the citation then. My guess is he initially pulled you over for something minor and then subsequently gave you the bigger ticket.

  • What if the car is in someone elses name (who has a valid drivers license that isnt under any type of suspension) and you have a suspended license? I mean they cant just look in the car and pull you over because they think its you?
