As soon as she acknowledged them or picked them up she was served! The server is supposed to sign an affidavit saying that they were served correctly, you should make sure that this has been signed. I'm not sure about CA, but in some states if the papers are pinned to the door they are considered served. The problem is that as soon as she says that she has them, but they weren't served correctly, she has acknowledged receipt! Challenging this will only delay the inevitable anyway, there's not much point in challenging service as they will just come back and do it again! It doesn't stop proceedings, just delays them slightly.

Egico is correct... Personal service is not always required, it depends on what the suit is for, sometimes the nail and mail is legal service sometimes they have to be delivered... delivered could mean thrown at your feet or put in your hand.
