  • If the position of the vehicles and any witness statements indicate that the accident was your fault it seems quite apparent that you failed to control your speed, otherwise you wouldn't have hit the other car.

  • I dont know how this works in the USa but I would imagine there needs to be evidence in witness statements if the officer did not see the event. Get an attorney - always get an attorney - otherwise the system will screw you even if you are innocent.
  • Did the officer sign the citation or was there a private prosecutor that signed? Officers issue citations, in accidents, based on their personal observation and experience. Many accident investigations by the police, allow officers to become experts in their accident report writing and testimony in court. Apparently, the officer had probable cause to issue you this citation.
