  • Tort claims all require that you suffer damages in order to recover. You may be able to recover nominal or punitive damages. Nominal damages would not be worth it, as you are usually awarded $1 (basically a court saying you are right, but you had no damages). In some states, punitive damages can only be collected if you were actually harmed. Other states allow you to sue for punitive damages even if you have no other damages. You may be able to make out a case for emotinal distress (which is a form of damage). However, you must look at the practical side of suing. First off, is the ex girlfriend judgement proof? Seeing that she works for a pizza place, she probably has very little assets to collect against. Can you sue the pizza place? Well, there is a theory of vicarious liability (the legal term is respondeat superior) that could make the pizza joint liable. However, this usually requires that the tortfeaser be acting within the scope of her employment.
