Yes and No. Any information you put on the net or get from the net is public while it is in transit, but what's on your computer is private. Monitoring a communication stream gets dodgy. If you listen to a data stream, then you are listening to a conversation, so you are listening. It is good if they listen to stop spam, but what they do with what they hear is the key.
