  • If your name is on the mortgage, contact an accountant and two lawyers. One a contract attorney, and the other a divorce attorney. I was given some good advice once. Find a good accountant, and ask the accountant to recommend your lawyers.
  • First off, this whole situation is a disaster waiting to happen. That is, you would be setting yourself up for an ugly divorce. Furthermore, you may not have the right to evict the roommate. If you and your husband own the home as joint tenants (which is most common), then each of you own an undivided 50% interest in the property. This means that your husband has the right to rent out any portion of the property. You, too, have a right to use the property. You may have a viable "ouster" lawsuit if having the tenant is preventing you from having access to the property. But that would only entitle you to compensation. Your best bet is to talk to your husband and work something out. In the meantime, file for divorce. If you didn't understand anything I wrote, let me know and I will clarify.
