  • You must fulfill the terms of the agreement unless the realtor has failed to do same.

  • How long is your contract? Before it comes up for renewal, find someone else!
  • Have you talked to the realtor about your dissatisfaction? that would be the first step. Tell them that you are unhappy and why. Make sure you say that you do not think they are fulfilling their side of the contract. Be specific about what you want from them. Put it all in writing. If they are still not carrying out the provisions of the contract you signed you can get out of it due to their lack of performance. If you can wait until the contract is up wait and get a new realtor.
  • You are in a legal binding contract/listing agreement. Typically, a listing agreement may have a clause that will allow the seller to take the property off the market, but that will not allow them to list the property with another agent until the listing expires. Be careful, you may owe two commissions. In my opinion, the best bet is to get the Broker on the phone, tell them you are displeased with the whole process so far, and they may release you from the contract since they have not spent any money on the marketing yet.
