  • here's what happened: i broke a company policy, one that everyone breaks unfortunately i was caught. 1 week prior to being written up, i was promoted title and all. the day my new boss called me in the office was the day we were supposed to discuss my raise, but in the end i was written up with an hourly wage decrease, plus the cut off my OT and put me on performance probation until february. but they never demoted me or changed me back to my old title. so i'm still doing 3 times the work under my new title making less thatn what i was originally making. and when i went to my hr office, they said that it was legal as long as they provide it in writing, but i asked over 4 days ago for her to provide it in writing for me, and i've yet to see anything. so before i make this a legal matter i wanted to get others opinions. this is in solano county in northern california too. thank you all for your feedback
  • No, the most they can do is not promote you or they can demote you and you will then get less pay.
  • Do you have an employment contract? If not, then yes, they can lower your pay or change your conditions of employment at will. If you do, then they must follow the dicipline procedures outlined in your contract. California is an at-will employer state. This means that you can be hired, fired, demoted, etc, for any reason (or no reason at all). The only exception is that your employer cannot take employment action for a discriminatory reason. You should be happy that you were not fired. Of course, the fact that you were not fired is a sign that you are valued at your company. This could give you some leverage to negotiate a pay raise.
