  • I'm not going to go through the number of "should of's" that she should have done to prevent this from happening. Unfortunately, because she is not on the mortgage, there is little she can do. Her only possibiity is to send in what is past due to the mortgage company to prevent foreclosure and continue to make the mortgage payments.
  • Couldn't she just refinance the home in her name? If he has abandoned the place, they will redo the Title work then, and if he's truly abandoned the place - he should willingly drop his name off it. I'm assuming this person on the deed (but not mortgage) could be a wife? In which case they should have access to payment information on it...or at least be able to get access, if the guy grants it. Still...if she's not on the mortgage and there isn't any equity worth protecting, or if this guy is too much trouble to work with, maybe the best bet is to let it go, and find her own place. She's not on the mortgage, so shouldn't show up as having had a foreclosure (right?). I'm not sure about that though.
  • sounds like a 'subj to' deal. she lease-options the house subject to the existing mortgate, collecting a large enough downpayment from a leasee to bring the mortgage current and get herself in a new place (apartment or rental). she can also create a monthly positive cash flow from the payments that would cover the mortgage and a little extra for her.
