  • I'm in a similar position, without the firing and in PA. I would say to be sure you better check out YOUR STATE'S web page/Worker's Comp info. I know they do not have to hold your exact position open for you, MY stores have been given to other merchandisers at this point. They can offer me work in an area I sure as heck have no interest in driving to...and if I don't that those locations, then, they can fire me or let me know if the locations I want open back up again. I'm looking for something else, personally, so that when I can return full time to work, I'll be doing something new and interesting. I'm still on Worker's Comp now...I thinks you need to speak with an attorney, and remember your 30 min consultation IS FREE! My understanding is that if you are still out on disability, or still disabled they can not just fire you, they would need to see if they can place you in another position! Good Luck!
  • Please go to the yellow pages of your phone book, shut you eyes and point a finger to any attorney. they will gladly handle your case and you will win.
  • I have a friend in Arkansas exact same story. In this state it is illegal to fire someone on workmans comp. They can however not allow you to come back to work with restrictions by saying they have nothing for you. I hope you have a good attorney if you dont GET ONE.
