Seat belts normally do not fit properly until a child is 4'10" (some say 4'8") and 80 lbs. By this it should be safe. I don't know if there are any laws passed on this though. I do know it would vary by state. http://health.utah.gov/vipp/motorVehicleSafety/cps.html
