Your car stopped on a busy street? That is your fault. Even in parking lots a stopped car is considered the fault, unless witnesses are there who can say that they clearly saw signals or that you slowed into the stop. Its more of a He Says She Says and the ruling is usually against the person rear ended in the middle of a street. At a stop sign or traffic light (without cameras) the ruling is in favor of the rear ended vehicle. This is the usual - unless you can spin a better story than the other person and the mood of the hearing judge -

Agree with Athrael, but to add: If it was a legal manuever (you weren't pulling a steven seagul 180 or something) and was executed legally (signal, gradual stop) then you should be able to at least bargain down to 50/50. I'm not sure I fully understand the situation though - were you backing into a driveway or something? Or were you parallel parking? It makes a difference. One word of advice: Pictures.
