  • What kind of visa? If it is a tourist visa he can remain in the US 6 months, after that he must leave and re-enter. And he will need to re-apply for a resident visa based on the marriage.
  • No, he cannot stay beyond his visitor permit. He needs a visitors visa/permit. They vary in length and can go up to 6 months. He must re-apply. In the meantime he must apply for permanent residency in the US...not citizenship.
  • he can stay in the US as long as you apply for a change of status with immigration from a tourist visa to a permanent resident based on marriage. However, know it is illegal to cross into the US planning on staying and marrying. If you tell a border guard your intent is to get married, he will deny you entry based on the grounds he feels you would over stay your yourist visa and stay illegally. You will have to show financial ability to support him as he cannot work until he recieves residency, you will have to show evidence of prior trips, phone bills etc. There will be a personal interview after approx 8 months at which the decision will be made. I just relocated from canada to the USA and have recently acquired my residency here in the US. the whole process took approx 9 months.
