Tell dad to look into a corporation license instead of having it in his own name. I believe that if his business goes under, it will not affect the house.

There are several things necessary for success: He needs to be a very good chef, his timing needs to be right, he needs a good location, and he needs the support of his family. If he can't get mom in line, he won't be able to get the dishwasher in line, nor the Maître d', the sous chef, and on down the line. It is normal for chefs to take significant risks to start a restaurant, because virtually no banks will give loans for restaurants, they're considered too risky. Time for a family pow wow. Don't be afraid to show them this, and don't be afraid to support him 100% if you think he has the right stuff.

Violent as in hitting, and verbal abuse? Well if that is the issue...mom should leave dad and take half the house before he looses the whole thing...then he can just figure out how to open up his own resteraunt. BUT if its just arguing...I really dont see why he shouldnt be able to open up a resteraunt...if its his dream...let him accomplish it. But there are some things that he needs to be great at before he could even consider it...or a partner that is equally as great in a different area. First he has to figure out a location and open something that is demanded in the area. If there is already 3 steakhouses on that side of town...obviously dont open one. Hes gotta be very good at what he does...have a good palette, and his family MUST support him...(if he opens it) if they do not, he WILL fail. 2nd...hes gotta figure out a secure financial system. Hes got to know accounting...hes got to understand the supply and demand...and how to order food right...to where hes not wasting supplies. Hes got to hire only the best workers, trustworthy, and punctual. And theres so much more. Its hard work opening your own resteraunt. It takes ALOT of time, ALOT of work, ALOT of hope, and ALOT of love. ...but seriously, if it turns into violence over all that...and he is going to go against your mom and open one anyways and put everything in jepoardy...she should follow the advice of getting hers before there is non of theres.

This sounds like a classic case. Your dad wants to start his own business before he gets too old to do so, while your mother seems to see only the hazards involved. Finding a compromise in here is difficult. Perhaps your dad could start smaller than he originally planned, thus not risking as much? Without knowing more, it would be very hard for me to say.
