They must be presumed innocent until proven guilty however obvious the evidence may appear - otherwise who decides where we draw the line?

Whilst first impression would indicate a certainty of guilt there are other factor which must be taken into consideration - could there have been anyone else involved? If this person acted alone what is their mental state? Do they understand what they have done etc?

Unless you are sure of the level of criminal intent involved how do you know how to sentence?

Innocent until proven guilty. No person should ever be sentenced without a fair trial.

It's the law that he be tried. This is to prevent innocent people from being wrongly incarcerated due to circumstantial evidence. To have a criminal record does not mean he's guilty of these particular crimes. I'm not saying he's not guilty. Only that he's entitled to a trial like everyone else. Have you ever heard the joke, "friends let you hideout at their place, true friends let you bury bodies"?. Just kidding.

Innocent until proven guilty. You'd hope that there would be enough evidence to convict him fairly quickly.... doesn't mean that we should dispense with a tried & tested process tho.

if they were presumed innocent they would not be arrested as a suspect. you do nto arrest innocent people. until they are proven guilty/other they are suspected.
everyone in america is given a trial and even if there are witnesses, video evidence and physical evidence proving you did it there is still a chance you will get off in out legal injustice system.
hell OJ was found innocent AND guilty!!!! I think he was guilty but that is neither here nor there, he was found innocent so he should not be found guilty as well.

Guilty. There are to many loopholes in the justice system and to little justice.
