My wife who is divorced has a child that lives at home and she always claimed on taxes however because an old divorce decree he claims the boy now. if the boy is living with mom and dad is now claiming son,who gets the EIC?

I recieved $19000.00 from my ex husband in our divorce. The money is my share of the equity of our house that he lives in and couldnt sell. do i need to claim this money as income and pay tax on it.
