It depends on the state laws, but the officer would have to be able to absolutely prove that the person illegally downloaded and show evidence.

I've heard that buying a physical copy of something (a book, a movie, a game) gives you the right to also own a digital copy of it. If this is true, then a cop would also have to prove that said person didn't own the game previous to downloading it.

Not really as the cop would have to justify the expense of tracing the individual and taking it to the prosecutor to present to court. Youj should never post something silly like that anyway.
