Do you think that if someone accuses someone of raping them and it's PROVEN beyond ANY doubt that the person accusing someone of rape is lying, that they should get the same sentence as the person would've if they had been convicted of rape?

    absolutely because during the process the "accusees" life is being turned upside down, people that heard of the accusation stay away from them, their spouse is looking at them in a new light (tho, depending on the bond that the marriage has, it may bring them closer). Their kids are going thru Hell. Yeah, if it's proven the the "accusee" is innocent, I think the accuser should stand trial for slander and false accusation, along with getting some counsling and time in jail.

    There are penalties for false police report and for perjury, but they are not as severe as the penalty for rape.

    The person who was accused should get a lawyer who can file charges against the liar and get compensation for the falsely accused, which might be even better. He can make her life a legal hell.

    Rape is typically a felony charge - if you're found to be lying about the charges you bring against someone, isn't it usually a misdemeanor at best?

    I think they should definitely be charged, but perhaps not with a felony.

    yeah that sounds like justice to me but you would have to prove without a doubt that she did not just make it up and that she did not atleast at some what that it was no where near rape

    I think the penalty for such an act should be severe.

    1. this act is why many women never come forward in fear of being accused of this.
    It is also why it is sometimes very difficult to get convictions on real rape cases.

    2. This type of crime seeks to falsely destroy someones life and take away their freedom.


    They should be locked away for a very long time.

    They will get a sentence oftentimes. You can't claim a lie. Perjury is illegal and misrepresentation of a crime is as well.

    Yes although proving that someone has lied is sometimes hard to prove. Did they knowingly accuse someone of rape who was not guilty?

    The problem for the legislator and the courts is this...how do you craft a law that allows someone making a false accusation to be prosecuted while protecting the victim who fails to prove their case in court?

    A not guilty verdict does not always mean the victim made a false accusation after all.

    There have been a couple cases in the news where women knowingly made false accusations. I agree, they ought to face the same sentence...but...how to accomplish this?

    A man or woman that makes an accusation of rape who wasn't raped potentially perverts justice for all real rape victims but we have to be careful to not put all rape victims on trial too.

    Having to go through a situation like this with my husband being accused of CSC and then being exhonerated of charges I think the accuser who falsely made these accusations should be exposed publicly and have to pay back every dime that the accused had to pay for attorney fees, etc. and I think the same way petafiles have to register I feel these selfish pigs who lie for their own selfish reasons need to have a registry for "people who defame others character" like a watch out for these people! Its verrrrryyyy sad that nothing is done to these people. AND I CONTINUE TO PRAY THAT IF SUCH A LAW COMES THAT THE CASE I EXPERIANCED WOULD BE THE FIRST ONE TO EXPOSE THIS ANIMAL WHO TRIED TO RUIN MY FAMILY.

    A comparable sentence. Perjury is taken very seriously by the courts - I imagine some would hold that her crime is actually worse than rape. It is a crime against the state. The state can get kinda fussy about that kind of thing. I agree with the lawsuit as well. I truly think that people who rape should be severely punished. When you set up serious punishment you also need to make sure that people are seriously afraid to make false accusations.

    No, but I believe they should be prosecuted with whatever is available in that jurisdiction for falsely accusing, malicious prosecution, unwarranted use of tax money etc.

    No way! Being accused and dragged through court can in no way be as traumatic as rape must be. Sentences should reflect the crimes and suffering.

    Why should it be proven beyone "ANY doubt" when it only takes "beyond a reasonable doubt" to convict them of rape?
