  • Is it “legal” is a vague question. There is nothing illegal about drafting a document and getting someone else to sign it. If you are asking whether or not the contract is binding, the answer is technically no, but you would likely lose if sued. A contract only exists if there is consideration on both sides. What this means is that all parties to the contract either confer a benefit, or suffer a legal detriment. Absent consideration, all you have is a promise to give a gift. This type of promise is not legally enforceable. Why does your boyfriend claim you owe this money? What it because an alleged loan? So long as he alleges that he conferred a benefit or suffered a legal detriment, he would win a lawsuit. This is because the signed agreement is prima facie evidence that a contact exists, that you would likely have no way of refuting.

  • A contract signed under duress is not legal. Plenty of last minute prenuptial agreements have been thrown out because of this. The trick is to show that you were indeed under duress. If you can provide enough evidence to show this convincingly, then this contract will not be binding on you.   • Did he have a gun to your head, do you have proof that you were forced? That contract is legal and binding if tis notarized. You are going to have a huge hill to climb to get anyone to sympathize with your plight unless you have a hell of a lawyer. You are stuck, honey.
