  • Ask an attorney in your state about that. It's my opinion that you can do that, but I don't know for sure, because depending on the age of your daughter, she might become very "confused" if her name is suddenly changed at a young age, and she wasn't "consulted" before it was done. +5
  • Yes you can. If the child was in the fathers last name then you would've had to ask him for permission to change your childs last name, which doesn't always turn out positive.
  • If the father is paying child support he can object and file for the child to have his last name. Properly, the stepparent should adopt the child to avoid future problems.   • if the father has never been in her life and isn't on her birth certificate i am sure you can do that. If however her father IS involved in her life, you would need his permission for the new guy to adopt her so that she could take his surname.
