Whats the difference between Capital Murder and 1st degree murder??? What is capital murder punishible by? Im in the state of florida if that helps?

    Capital murder is murder charged under the highest felony (capital felony). This would be murder in a criminal episode where several people were killed or killing a peace officer.

    First Degree Murder: All premeditated murders, and (in some states) murders involving certain especially dangerous felonies, such as arson or rape, or committed by an inmate serving a life sentence.

    "capital" refers to the old system where the punishment could be death. These days we refer more to degree of murder or manslaughter, since CAPITAL punsihment has been set aside in most countries, except for cases of treason and military judgements.

    It depends on the state. In texas, which is where I'm from, if someone murderers an on-duty police officer, it's capital murder and can result in the death penalty. Also, if someone murders someone under the age of six, it's also considered capital murder. lastly, capital murder can be more than one crime. For an example, if someone kidnaps, rapes, and murders a child, they can be charged with capital murder, especially if the child was younger than six. Basically, capital murder is a type of murder than can result in death. hence the word 'capital" in "capital murder" and "capital punishment"; every capital murder results in the death penalty. First-degree murder is the intent to kill. For an example, I was watching Nancy Grace and there was a story about a woman who shot her two kids to death. She bought the gun a head of time, so her murder was planned. She is being charged with two counts of first degree murder since she murdered two people. She could face up to life in prison or even get the death penalty. The story I'm talking about actually happened in Florida, so you have probably heard of it on the news. From my research, Florida does have the death penalty and does give it quite often. If the murder happened because the person was defending themselves, they could be charged with manslaughter, which only gives them ten years in prison. If someone does not have a criminal history and is only charged with one count of first degree murder, they could only get 10 years in prison, maybe 15, depending on the severity of the case. It's very difficult to get the Insanity defense and if someone is proven to be insane during the time of the murder, they go to a mental hospital until a judge determines they will no longer be a threat to themselves or other people. So, basically, capital murder is a homicide that results in the death penalty(usually more than one crime happens, such as rape and kidnap) and first degree murder is an intent to kill(meaning you planed to kill someone) and usually just results in either ten years in prison, fifteen years, or even life; if someone does more than one count of first degree murder, it could give them the death penalty.
