If the batter is out of the box, is the pitcher allowed to be on the rubber in the set or wind position getting signs?

he can be on the rubber, but can NOT be taking signals. the 3rd base umpire watches this

Nothing in the rules prevents the pitcher from engaging the pitcher's plate or taking signs while the batter is not in the batter's box. The only stipulation is that he cannot deliver a "quick pitch" (pitch before the batter is reasonably ready).
