  • The answer to your question will vary from state to state, so there's no simple answer. For that matter, I'm not sure all states let the child "choose." I think in most states it's not a matter of the child choosing but what age the child has to be before the court will consider the child's wishes in the matter.
  • By the time a child reaches the early teens, the courst will usually listen to their wants in the matter. The extent to which they act depends on the jurisdiction in which you live and the attitude of the judge hearing the case. By the time a child is about 16, there is little the court can do to force the child to live with a parent they do not want to live with, unless there is a very good reason otherwise (e.g., abusive parent).
